USA and Canada Privacy Notice Addendum

This Privacy Notice Addendum provides additional information for residents of the United States and Canada regarding the Personal Data we collect about you, what we do with it, and how you can control. This Addendum should be read in conjunction with the main Flora Food Group Privacy Notice.Please note that which Data Protection Law applies depends on the jurisdiction in which you live.

Definitions
The definitions set out in the main Flora Food Group Privacy Notice are incorporated into and form part of this Addendum and for the purposes of this Addendum the following additional definitions shall apply:
1. “Canadian Data Protection Laws” means any Canadian federal or provincial law concerning the processing of Personal Data, as implemented in the relevant province, including, but not limited to: Canadian Personal Information Protection and Electronic Documents Act, Alberta Personal Information Protection Act, British Columbia Personal Information Protection Act, and Québec Act respecting the protection of personal information in the private sector.
2. “Supervisory Authority” means the applicable local official body or agency that is responsible for ensuring compliance with either USA or Canadian Data Protection Laws, which handles complaints and has enforcement and/or investigatory powers, including but not limited to the California Privacy Protection Agency or the Office of the Privacy Commissioner of Canada.
3. “USA Data Protection Laws” means any US state law concerning the processing of Personal Data, as implemented in the relevant US state, including, but not limited to: the California Consumer Privacy Act 2018, Cal. Civ. Code §§ 1798.100 et seq. (as amended), the Virginia Consumer Data Protection Act (as amended), the Colorado Privacy Act, the Connecticut Privacy Act, and the Utah Consumer Privacy Act.

Lawful basis for processing your Personal Data under USA and Canadian Data Protection Laws
Some US state and Canadian Data Protection Laws may also require us to have a legal basis for collecting and using your Personal Data. As well as the existing lawful bases in the main Flora Food Group Privacy Notice, for residents of the United States and Canada we may also rely on one or more of the following legal bases:
Appropriate in the Circumstances (PIPEDA Section 5(3)) We will only collect, use or disclose Personal Data only for purposes that a reasonable person would consider are appropriate in the circumstances. Reasonably Necessary Cal. Civil Code §1798.100(c) We will only collect, use, retain, or share Personal Data to the extent reasonably necessary and proportionate to achieve the purposes for which the Personal Data was collected or processed, or for another disclosed purpose that is compatible with the context in which the Personal Data was collected. -
International data transfers under USA and Canadian Data Protection Laws
Your Personal Data is transferred and processed outside of the USA (or any state therein) and/or Canada (or any province therein). These countries may have data protection laws that are different to the laws of your country.
Any transfer of your Personal Data outside the USA or Canada will be carried out in accordance with USA and Canadian Data Protection Laws in order to safeguard your privacy rights and to provide you with remedies in the unlikely event of a security breach.

Non-discriminationWe will not deny, charge different prices for, or provide a different level of quality of goods or services if you choose to exercise any of the rights listed within this Addendum.

Processing of children’s Personal DataWe do not knowingly process, share, or sell the Personal Data of children we know to be under the age of sixteen (16), unless a parent or guardian has provided consent.

USA residents
If you are a resident of California, under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain Personal Data are entitled to request and obtain from us, free of charge, information about the type of Personal Data that has been disclosed and the names and addresses of all third parties to which such information has been disclosed for direct marketing purposes. Such requests may be made once per calendar year for information about any relevant third party sharing in the prior calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to privacy@florafg.com. In your request, please attest to the fact that you are a California resident and provide a current California address.
If you are a resident of a US state with a right to appeal, and you would like to submit an appeal about our decision to your request regarding your Personal Data, you may contact us at privacy@florafg.com. We respond to all appeal requests as soon as practical, but no later than legally required.
